Dezinery Product Liability Policy
1. Purpose
This Product Liability Policy outlines the allocation of responsibilities regarding product safety, compliance, and customer protection between Dezinery and its third-party suppliers under a drop-shipping business model.
2. Dezinery’s Role
Dezinery is an online marketplace that connects customers with independent suppliers who design, manufacture, or fulfill products. Dezinery does not own, warehouse, or manufacture any of the products sold on its platform.
3. Supplier Responsibilities
All suppliers on Dezinery are required to:
- Ensure that all products listed and sold comply with applicable safety regulations, industry standards, and consumer protection laws in the countries where they are sold.
- Provide accurate, complete, and truthful product descriptions, including any warnings or usage limitations.
- Maintain appropriate product liability insurance, where applicable.
- Assume full responsibility for any claims, damages, injuries, or losses resulting from the use of their products.
4. Customer Claims & Resolution
If a customer experiences an issue related to product safety, Dezinery will:
- Act as an intermediary to facilitate communication between the customer and the supplier.
- Collect and document all relevant evidence (e.g., photos, descriptions, receipts).
- Support the resolution process, including issuing refunds or removing the supplier if necessary.
Dezinery may cooperate with legal authorities or regulators in the event of a formal investigation or claim.
5. Limitation of Liability
Dezinery shall not be held liable for:
- Defective, unsafe, or non-compliant products sold by third-party suppliers.
- Injuries, damages, or losses resulting from supplier-provided products.
- Supplier misrepresentation of product features, materials, or origin.
Dezinery reserves the right to suspend or terminate any supplier found to be in violation of this policy or posing a risk to consumer safety.
6. Indemnification
Each supplier agrees to indemnify and hold harmless Dezinery, its affiliates, and its officers from any claims, liabilities, damages, losses, or legal costs arising out of:
- Defective or unsafe products,
- Infringement of third-party rights,
- Violation of laws or regulations.
7. Insurance Recommendation
Suppliers are strongly encouraged to obtain and maintain product liability insurance that covers their products and operations in all markets they sell to via Dezinery.
8. Policy Enforcement
Dezinery monitors customer complaints, reviews, and supplier performance. Any supplier found to be in violation of this policy may face:
- Temporary or permanent removal from the marketplace,
- Withholding of payments or refunds,
- Reporting to regulatory authorities, where applicable.
